Vietnam Visa Sponsorship Jobs in 2026: Work Permit, LD Visa and TRC Rules

Vietnam visa sponsorship jobs in 2026 normally require an eligible Vietnamese employer to obtain a work permit for a named foreign worker before employment begins. The worker then uses the appropriate immigration route, commonly an LD2 employment visa and, for a longer stay, an LD2 temporary residence card. Workers who legally qualify for an exemption use a different labour confirmation or notification process and may qualify for LD1 immigration status.

The controlling labour framework is Decree 219/2025/ND-CP, effective since 7 August 2025. Older guides built around Decree 152 can now give the wrong filing sequence, definitions and evidence rules. A credible 2026 offer should identify the exact worker category, filing authority, work location and immigration code.

Choose the correct Vietnam employment route

Route Who it covers Labour document Immigration status
Standard sponsored employee Eligible manager, CEO, expert or technical worker hired by a Vietnam entity Work permit under Decree 219 Usually LD2 visa and potentially LD2 temporary residence card
Work-permit exemption A worker who fits a statutory exemption Exemption confirmation or required advance notification Usually LD1 where immigration conditions are met
Intra-company transferee Qualifying transfer within a foreign enterprise in covered WTO service sectors Exemption evidence, including prior overseas employment LD1 or other correct status after approval
Short-duration exempt worker Qualifying manager, CEO, expert or technician working under 90 total days in a calendar year Exempt from confirmation in specified cases, but advance employer notification applies Correct entry status remains necessary
Investor or family status Qualifying investor or dependant Separate work authorization is still assessed Investor or family residence does not automatically legalize employment

LD1 and LD2 are immigration classifications, not substitutes for the labour document. LD1 corresponds to a worker who does not need a work permit under the applicable exemption. LD2 corresponds to a worker who must hold one. A company should not bring a candidate on a generic business or tourist status and promise to regularize paid work after arrival.

The employer-led sequence under Decree 219

  1. The employer defines the lawful role. It determines whether the candidate is a manager, CEO, expert, technical worker or a person working under another permitted form.
  2. The candidate assembles evidence. Qualifications, experience, passport, medical evidence and criminal-record documents must meet current form, age, translation and legalization rules.
  3. The employer files the labour application. A permit application is submitted between 60 and 10 days before the planned first day.
  4. The authority decides the application. The stated period is ten working days after receipt of a complete file. An unsuccessful application receives a written reason within three working days.
  5. The parties complete the employment contract. The role, employer, location and validity should align with the permit.
  6. The sponsor completes immigration steps. The worker obtains the correct LD visa or status and, where appropriate, a temporary residence card.
  7. Changes are reported or re-filed. Another employer, materially different role or unapproved location cannot simply inherit the original permission.

Decree 219 integrates the employer’s explanation of foreign-labour demand with the permit request through the prescribed form. This is one reason older articles describing a universal separate pre-approval stage should not be followed without checking the current provincial procedure.

Who qualifies as a foreign expert?

An expert ordinarily needs a bachelor’s degree or higher, or equivalent, and at least two years of work experience relevant to the proposed Vietnam position. Both parts matter. A degree in an unrelated discipline combined with a generic experience letter can fail the role-fit test.

A narrower rule allows at least one year of relevant experience when the candidate has a relevant university-level qualification and will work in finance, science, technology, innovation, national digital transformation or another priority development field identified by the competent authority or a government cooperation arrangement.

The one-year provision is not a general shortcut for every graduate. The employer should explain why the field is covered and how the degree and experience match the actual duties. Candidates should obtain detailed letters showing job title, dates, responsibilities and issuing employer rather than a one-line certificate saying only that they were employed.

Managers and chief executive officers

A manager must fit the enterprise-law definition or be the head or deputy head of an agency or organization. A CEO category includes the head of a branch, representative office or business location, and can include a person directly managing a field of an organization or enterprise with at least three years of suitable experience.

A decorative title is not enough. “Director” on a business card does not establish control over an organization, branch or defined operational field. Corporate appointment documents, organizational charts, charter materials and experience evidence should be consistent with the proposed role.

Technical-worker requirements

A technical worker qualifies through one of two evidence paths. The first is at least one year of training plus at least two years of relevant work experience. The second is at least three years of relevant technical experience. The experience must be suitable for the intended work in Vietnam.

This category can support genuine technicians in manufacturing, industrial maintenance, installation, quality systems and specialised operations. It does not make every entry-level factory or warehouse vacancy sponsorable. A mass advert offering immediate permits to applicants with no training or experience conflicts with the category’s evidence requirements.

Documents for the work-permit file

A standard application includes the employer’s prescribed request and demand explanation, an unexpired passport, medical evidence, criminal-record evidence, photographs, proof of the working form and documents establishing the selected worker category. The authority can require additional evidence based on the role and filing route.

The criminal-record certificate or equivalent confirmation normally must have been issued within six months before filing. Qualifying foreign medical evidence cannot be older than twelve months and depends on recognition rules. Applicants should not obtain time-sensitive documents so early that they expire before the employer files.

Foreign-issued records generally require consular legalization unless an applicable treaty, reciprocity rule or other law provides an exemption. Legalized records are translated into Vietnamese and authenticated. Ask the sponsor for a document matrix before paying for legalization because processing the wrong version can waste weeks.

Work-permit timing and validity

The employer files no more than 60 days and no fewer than 10 days before the proposed start. The competent local authority has ten working days from a complete application to decide and issue the permit. That is a decision target after completeness, not a promise that document collection, legalization and immigration will finish in ten days.

The permit follows the validity of its supporting employment, assignment or business document and cannot exceed two years. Renewal is a separate process with its own filing window and evidence. Passport validity, contract duration and immigration permission can produce a shorter practical stay.

Work-permit exemptions

Vietnam law contains exemptions for specified owners or capital-contributing members, certain service providers, lawyers, volunteers, treaty assignments, approved education roles, short-duration specialists and qualifying intra-company transferees, among others. The exact conditions differ.

Some exempt workers require a formal confirmation; specified categories instead use employer notification at least three days before work begins. “Exempt” therefore does not mean that the worker can arrive and start without paperwork. The employer must identify the legal paragraph and complete the corresponding confirmation or notification.

The short-duration rule for qualifying managers, CEOs, experts and technical workers applies where work totals fewer than 90 days from 1 January through 31 December. Splitting one continuing job into repeated visits does not remove the annual cap or the employer’s notification duties.

Intra-company transfer exemption

A qualifying transferee must move within a foreign enterprise that has established a commercial presence in Vietnam in one of the covered WTO service sectors. The overseas company must have employed the worker continuously for at least twelve months before the transfer.

The route needs evidence of the foreign employment, commercial relationship, Vietnam presence and worker category. A new recruit hired abroad solely to be sent immediately to Vietnam will not satisfy the twelve-month condition. An affiliate relationship by itself is not proof that all exemption requirements are met.

LD1 and LD2 visas

LD2 is the immigration code for a foreign worker who is required to have a work permit. LD1 covers a foreign worker whose employment is exempt, except where an applicable treaty provides otherwise. The sponsor submits the relevant invitation or immigration file after the labour position is documented.

A visa allows entry and stay for its stated purpose. The work permit or lawful exemption controls employment. Candidates should verify the code, permitted stay and labour document instead of relying on the phrase “business visa,” which is often used loosely by recruiters.

Temporary residence cards

Eligible LD1 and LD2 workers can use their employer sponsorship and labour evidence to seek a temporary residence card. The card can reduce repeated visa extensions and support a stable stay, but it remains linked to the qualifying purpose and sponsor.

Employment-category temporary residence cards are generally capped at two years and must expire at least 30 days before the passport. If the job ends, the employer and worker should address permit revocation, residence sponsorship and departure or status change promptly. A plastic card is not permanent residence.

Working in more than one province

Decree 219 permits a worker with an existing permit to work for the same employer in multiple provinces or centrally governed cities, but the employer must notify the authority in the additional location at least three days before work starts there. The assignment cannot exceed the permit’s validity.

This is useful for installation, regional management and technical service roles. It is not open portability between unrelated companies. Travel to a customer site should be distinguished from actually performing contracted work there, and the employer should keep the required notice.

Changing employer, job or passport details

A permit is issued for a defined employer and job. Moving to another legal employer normally requires that employer to complete a new application before work begins. A substantially different role can also require a new assessment because qualifications and experience were approved against the original duties.

Reissuance is available for an unexpired permit that is lost or damaged and for specified changes such as name, nationality, passport number, workplace or an employer-name change that does not change the employer’s identification number. Reissuance should not be mistaken for transferring a permit to a different company.

Employment contract and salary checks

Vietnam does not publish one universal foreign-worker sponsorship salary that makes any application eligible. Pay should be commercially credible for the role, meet labour-law requirements and match the contract, payroll, tax and social-insurance treatment that applies.

The written contract should identify the legal employer, position, duties, work provinces, gross and net pay, currency, allowances, probation, hours, leave, insurance, housing, tax, relocation, termination and repatriation. The executed terms should not contradict the permit or supporting offer.

Clarify whether salary figures include a thirteenth-month payment, housing, transport, meals, private medical insurance or tax equalization. A high headline figure can be misleading when compulsory deductions or housing costs are omitted.

Regulated professions and qualifications

A work permit does not replace a professional licence. Medicine, pharmacy, law, education, aviation and other regulated activities can require recognition, language ability, institutional approval or a Vietnamese professional credential. The employer should identify the regulator and expected timeline before recruitment.

Teachers should verify school licensing and any education-sector conditions. Engineers and technical managers should make sure their duties fit the approved category. The safest file uses specific evidence tied directly to the job description rather than relying on prestige of the employer or degree.

Where Vietnam sponsorship is realistic

Foreign sponsorship is most credible where an employer can explain a skill, management or technical need. Common areas include advanced manufacturing, electronics, semiconductors, industrial engineering, quality systems, supply-chain management, software, cybersecurity, data, finance, renewable energy, specialised construction, hospitality leadership, international education and regional corporate functions.

Entry-level packing, cleaning, driving, retail and generic office jobs rarely fit the expert or technical-worker evidence described above. Applicants seeking regional alternatives can compare TrendyAcads’ Thailand Non-B and work-permit guide and Malaysia Employment Pass guide.

How to verify a Vietnam offer

Check Credible evidence Warning sign
Employer Vietnam legal name, enterprise code, office, domain and staff interview Recruiter hides the employing entity
Worker category Manager, CEO, expert or technician test tied to duties “Open work permit” with no role
Application Employer-led National Public Service or competent provincial filing Candidate buys a permit from an agent
Immigration Correct LD1/LD2 invitation, visa and residence process Tourist or generic business entry sold as work permission
Documents Clear legalization, translation and validity checklist Forged degree or experience letter offered for a fee
Payment Transparent lawful charges with invoice Crypto, gift card or unrelated personal account

Common sponsorship scams

  • A guaranteed two-year permit for a candidate with no qualifying training or experience.
  • An “LD visa” sold without an identifiable employer or labour application.
  • A tourist or e-visa described as permission to start a factory job.
  • A fake provincial approval or altered work-permit image.
  • A broker offering to manufacture an experience letter, degree or criminal record.
  • An advance fee for a job at a company that never interviewed the applicant.
  • A contract naming one company while the worker will serve another.
  • A request for bank credentials, one-time passwords or remote-access software.

Do not pay for a permit as though it were a transferable commodity. Search the legal employer, contact it through an independently found channel, interview with operational staff and ask for the filing plan. Keep the advert, correspondence, signed contract, receipts, permit, visa and residence records.

A practical application strategy

Start with the category rather than the visa. Compare your degree, training and dated experience against the intended duties. Prepare detailed employment certificates, then ask the employer which provincial authority will receive the application and who handles legalization and translation.

Do not resign or book non-refundable travel until the employer has a credible permit path. When approval is issued, compare the employer, title, workplace and validity with the contract. Complete LD visa and temporary-residence steps separately and keep track of every expiry date.

Frequently asked questions

Can I work in Vietnam on an LD2 visa without a work permit?

No. LD2 is the immigration category for a person who is required to hold a work permit; it does not replace that permit.

How long does the work-permit decision take?

The current procedure gives the authority ten working days after receiving a complete application. Document preparation, legalization and corrections add time before that clock is meaningful.

Can a new graduate qualify as an expert?

Usually not through the standard expert route, which requires relevant experience. The reduced one-year provision is limited to qualifying priority fields and still requires a relevant university-level qualification and experience.

Can I change companies with the same permit?

No. A different legal employer normally files a new work-permit or exemption case before the new employment begins.

Does the under-90-day exemption mean no paperwork?

No. It is limited to qualifying managers, CEOs, experts and technical workers and requires the applicable employer notification before work.

Can my work permit last more than two years?

No initial permit under this framework exceeds two years, and the underlying contract, assignment or passport can make the approved period shorter.

Final assessment

A genuine Vietnam sponsorship case starts with an eligible role and employer, not a visa label. The strongest applications match the candidate to a Decree 219 category, use current legalized evidence, respect the 10–60-day filing window and complete labour and immigration stages in the correct order.

Research checked 30 September 2026 against Vietnam’s Ministry of Justice legal database, National Public Service Portal, Vietnam Social Security guidance and Immigration Department materials. Procedures, fees and documentary practice can change; confirm the current requirements with the competent authority before applying, paying or travelling.
